The federal appeals court has maintained a ban on sending state troops in Portland, Oregon, after a latest court ruling.

Appeals Court Agrees to Rehear Legal Matter

The federal appeals court ruled on this week that it would rehear the case concerning the executive power with an larger panel of 11 judges. The court also vacated a earlier ruling from a three-judge panel that had supported the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent turn in a long-running court case over whether the administration has the authority and valid reason to send national guard forces in the city. Approximately two hundred troops have been in limbo since the end of September when the deployment effort was initiated in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the immigration center in the southern part of the city were facing threats, while city and state officials assert that municipal police have control of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, residents have been posting videos of scenic paths and a thriving food scene, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this period – one preventing the federal control of the Oregon national guard, and another stopping the use of any national guard troops in Oregon, after attempts to circumvent the initial injunction by calling up troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the forces.

The latest ruling means the issue will be heard by the full court – with all decisions under consideration simultaneously – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the armed forces into American urban areas unnecessarily. We will continue defending Oregon’s laws, principles, and sovereignty as this case progresses and our fight continues in the judicial system.”
